The Alaska Bar

The Alaska Bar Association is an instrumentality of the State of Alaska created by Alaska Statutes 08.08.010 et. seq. Under the authority of the Alaska Bar Rules adopted by the Alaska Supreme Court, the Bar Association is responsible to the court for the administration of the bar admission and discipline process.

The Discipline System

All lawyers who are licensed to practice in Alaska are governed by ethical rules, known as the Rules of Professional Conduct, adopted by the Alaska Supreme Court.

The Bar Association administers these rules through a 12 member Disciplinary Board of three citizens and nine lawyers. The Disciplinary Board appoints a lawyer (the Bar Counsel) and staff who are assigned to independently investigate and prosecute allegations of lawyer misconduct.

The Alaska Supreme Court has delegated to the State Bar the authority to investigate charges against lawyers. Lawyer discipline is funded by annual dues paid by all members of the Bar, not by tax dollars.

The primary purpose of the disciplinary process is to protect the public. Lawyers engaged in serious misconduct, such as lying to the court, theft of client funds or certain crimes, may be suspended or disbarred. Other types of misconduct, such as not communicating with clients or failing to diligently pursue a case, may result in a lower level of discipline including an admonition, probation or reprimand if deemed serious enough. Generally, concerns about isolated instances of rude behavior will not result in a discipline investigation.

The State Bar's jurisdiction is limited to investigating matters that if true would violate the Alaska Rules of the Professional Conduct. You can find a copy of the Rules here: Alaska Rules of Professional Conduct
